“In tema di deposito telematico di un atto processuale che abbia avuto come esito, dopo la ricezione della ricevuta di accettazione, un messaggio contenente la comunicazione dell’errore E0606, tale deposito deve ritenersi come mai avvenuto, con la conseguenza che l’interessato deve immediatamente attivarsi, ove non sia ancora scaduto il termine previsto per l’esecuzione dell’incombente, per effettuarlo. Non potendo, qualora il nuovo deposito avvenga regolarmente solo una volta decorso il termine ex art. 369 c.p.c., ottenere di essere rimesso in termini esclusivamente in ragione della tipologia di errore occorso.”
